1 Acceptance

By downloading, installing, or using Showmatic (the "App"), you agree to these Terms of Use and to Apple's Licensed Application End User License Agreement, which governs all software distributed through the App Store. If you do not agree, do not install the App, and delete any copy you may already have.

2 Licence to use Showmatic

Subject to these terms, you are granted a personal, non-transferable, non-exclusive licence to install and use the App on any iPhone or iPad that you own or control and that is signed in to your Apple ID, consistent with the usage rules set out in Apple's Media Services Terms.

3 Showmatic Pro in-app purchase

Showmatic Pro is a non-consumable in-app purchase sold at US $24.99 (equivalent local prices apply and are shown in the App Store before confirmation). It permanently removes the export length cap and the watermark, and includes all future improvements to Pro features. Payment is charged to your Apple ID on confirmation of the purchase.

Showmatic Pro can be restored on any device signed in with the same Apple ID from the app. Major new categories of functionality, such as the planned Showmatic Max laser features, may be offered as separate purchases; ongoing improvements to existing features are always included in Pro.

4 The free tier and the watermark

The free tier is fully functional for building shows: the beat engine, the timeline, and every editing tool work without payment or an account. Videos exported on the free tier are limited to 30 seconds and carry a small Showmatic watermark. Editing is never time-limited and your shows are never locked.

5 Refunds

All purchases are handled by Apple. Refund requests are therefore submitted to Apple at reportaproblem.apple.com. Apple makes the final decision on refunds. If you believe a charge was in error or the App did not function for you, we encourage you to write to us at contact@showmatic.app first, so we can help you resolve the underlying problem or advocate for your refund where appropriate.

6 Your content and acceptable use

You retain all rights to the songs, GIFs, clips, and shows you create or import. We do not claim any licence or ownership over your content; we cannot, in any event, since your files never leave your device. You agree to use the App only for lawful purposes and not to use it to infringe the intellectual-property rights of others or violate applicable law.

7 Music, clips, and other people's rights

Showmatic builds shows out of music and clips you supply. It is your responsibility to ensure you have the rights you need for the material you import and, especially, for any video you export and publish: a song you bought for listening is not automatically licensed for use in a published video, and GIFs and clips pulled from the internet may carry their own restrictions. Many platforms operate their own music-licensing arrangements and content-ID systems; whether a given export is allowed on a given platform is between you, the rights-holders, and that platform.

8 Updates and availability

We may issue updates to the App to add features, fix bugs, and maintain compatibility with new versions of iOS. Updates are distributed through the App Store and are subject to its delivery mechanism. We do not guarantee that every past feature will remain available indefinitely; where a feature is removed or significantly changed, we will note the change in release notes. Compatibility with a given iOS version is stated on the App's App Store page.

9 Intellectual property

The App, including its name, icon, wordmark, user interface, source code, and accompanying documentation, is owned by us and is protected by copyright, trademark, and other intellectual-property laws. These terms grant you a licence to use the App, not any rights in the App itself, except as expressly stated here or in Apple's End User License Agreement. Third-party components are used under their respective licences, which are available on request.

10 Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or suitable for any particular use, or that any data you process will be preserved without corruption. Keep copies of songs and clips that matter to you.

11 Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability to you for all claims arising out of or relating to the App or these terms shall not exceed the greater of (a) the amount you have paid to Apple for the App and its in-app purchases in the twelve months preceding the claim, and (b) five US dollars. In no event shall we be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

12 Governing law

These terms are governed by the laws of the jurisdiction in which the App publisher is established, without regard to conflict-of-laws rules. Where applicable mandatory consumer-protection laws in your country of residence grant you additional rights, those rights are not affected by this clause.

13 Changes to these terms

We may revise these terms from time to time. The revised version takes effect when it is posted on this page, and we will update the date at the top accordingly. Your continued use of the App after a revised version is posted constitutes acceptance of the revised terms. Where a revision materially reduces your rights, we will make reasonable efforts to notify you inside the App before the change takes effect.
